By downloading, installing, or using the Equinex mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Equinex is a mobile application designed to help horse owners manage their horses' health records, appointments, feeding schedules, and related information. The App may include features such as:
- Horse profile management
- Appointment scheduling and reminders
- Feed schedule tracking
- AI-powered image analysis (for educational purposes only)
- Notes and health records
- Account sharing and team collaboration
3. Subscriptions and Payments
3.1 Subscription Plans
Equinex offers various subscription plans (Free, Basic, Family, Pro, and Pro Plus) with different feature sets and limits. Subscription details and pricing are displayed within the App.
3.2 Auto-Renewal
Paid subscriptions automatically renew at the end of each billing period (monthly or yearly) unless cancelled at least 24 hours before the renewal date. You will be charged through your Apple ID or Google Play account.
3.3 Cancellation
You may cancel your subscription at any time through your device's subscription settings:
- iOS: Settings → [Your Name] → Subscriptions
- Android: Google Play Store → Menu → Subscriptions
Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial subscription periods.
3.4 Price Changes
We reserve the right to change subscription prices. You will be notified in advance of any price changes, and the new price will apply to your next renewal period.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Upload malicious content or code
- Use the App to store or transmit infringing or illegal content
- Resell or redistribute the App or its services
6. AI Features Disclaimer
IMPORTANT: The AI-powered features in Equinex, including image analysis, are provided for informational and educational purposes only. They are NOT a substitute for professional veterinary advice, diagnosis, or treatment. Always consult a qualified veterinarian for any health concerns regarding your horse.
7. Intellectual Property
The App and its content, features, and functionality are owned by Equine-X LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.
8. Data and Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EQUINE-X LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
11. Indemnification
You agree to indemnify and hold harmless Equine-X LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the App or violation of these Terms.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms within the App. Your continued use of the App after such changes constitutes acceptance of the updated Terms.
13. Termination
We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
